Terms of Service

1. Agreement to Terms

By accessing or using Quizily ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Quizily is a real-time quiz hosting platform that allows users to create, host, and participate in interactive quizzes. The Service includes AI-powered quiz generation, the ability to upload and use your own custom quiz content, real-time multiplayer gameplay, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have parental consent to use the Service.

4. Pricing and Payment

Quizily offers the following plans:

  • Free Plan: Access to daily pre-generated quizzes with up to 10 players per room
  • 24-Hour Pass ($5): One-time purchase for 20 quiz generations with unlimited players
  • Monthly Subscription ($10/month): 50 quiz generations per month with unlimited players

All payments are processed through Stripe. Prices are in USD and do not include applicable taxes. Monthly subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis; contact us for assistance.

5. User Content

You retain ownership of content you create or upload ("User Content"), including custom quiz questions, answers, and related materials. By submitting User Content, you grant Quizily a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for operating the Service and enabling gameplay.

Custom Quiz Content: When you upload or create quizzes, this content is saved to your account and may be used across multiple game sessions. During gameplay, quiz content (including questions and answers) will be displayed to all participants in the game room.

Your Responsibilities: You are solely responsible for your User Content. You represent and warrant that:

  • You have all necessary rights to submit your content
  • Your content does not infringe any third-party intellectual property rights (including questions from commercial quiz games, copyrighted educational materials, or proprietary test content)
  • Your content does not violate any applicable laws
  • Your content is not defamatory, harassing, or harmful to others

We reserve the right to remove any User Content that violates these Terms, without prior notice.

6. AI-Generated Content

Quizily uses artificial intelligence to generate quiz content based on user-provided topics. AI-generated content is provided "as is" and may contain errors or inaccuracies. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You are responsible for reviewing and verifying any AI-generated quizzes before use.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property or privacy rights
  • Distribute harmful, offensive, or illegal content
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service's operation
  • Use automated systems to access the Service without permission
  • Resell or commercially exploit the Service without authorization
  • Upload quiz content that infringes copyrights (including questions from commercial trivia games, standardized tests, or proprietary educational materials)
  • Create quizzes designed to harass, defame, or target specific individuals
  • Use the Service to administer unauthorized copies of professional certification or academic examinations

8. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Quizily and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent. The Quizily name and logo are trademarks of Quizily.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZILY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us. Sections that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
